Constitutional Development

The Constitutional development in Egypt was related to the country's struggle for independence and liberation. All national efforts exerted towards the promulgation of a constitution were undermined by foreign occupation forces. We could say that the first Egyptian constitution, worth of the word, was promulgated in 1882 after an extensive arduous struggle since 1805. However, the first real constitution was promulgated on April 19, 1923 after declaring the abolishment of the British Protectorate in Egypt on February 28, 1922. In accordance with the articles of this constitution, the first Egyptian parliament session was held in 1924.

The 1923 Constitution remained in force until it was abolished on October 22, 1930. It went into effect for some time again until the outbreak of the July Revolution in 1952. Since then Egypt has witnessed many constitutional developments:

• The promulgation of what was termed "the Constitutional Declaration" on December 10, 1952, which lead to the abolishment of the 1923 Constitution. A committee was set up to draft a new constitution according to what the government considered as sublime constitutional principles.

• Another constitutional declaration was issued on January 16, 1956.

• A Constitution issued on June 23, 1956, as a result of a public referendum was considered the first constitution of Egypt's Republic after the abolishment of the Monarchy.

• The Constitution of the Unity promulgated in March 1958 came in the wake of the Unity between Egypt and Syria on February 22, 1958 and the creation of the United Arab Republic.

• The Interim Constitution of March 25, 1964 replaced that of the United Arab Republic after the separation of the two countries in September 1961.

• The existing Constitution of September 11, 1971 which was recently amended in 2005 after a public referendum.
